Bagong Extension Hall Building sa Lupang Arenda, Pina-Sinayaan

Lupang Arenda Extension Hall
Kamakailan ay pormal na pina-sinayaan ang bagong tayong Barangay Extension Hall sa lugar ng Lupang Arenda, Barangay Sta. Ana, Taytay, Rizal.

Kasabay ng flag ceremony ng mga empleyado at opisyales ng Pamahalaang Barangay na ginaganap tuwing unang Lunes ng buwan, pormal na binuksan ang naturang gusali sa pamamagitan ng isang Ribbon Cutting at Blessing Ceremony, sinundan ng solidarity messages ng mga kagawad at ni Punong Barangay Joselito Calderon.

Ang bagong gusali ay simbolo lamang ng taus-pusong paglilingkod ng Sangguniang Barangay ng Sta. Ana lalo na para sa mga taga-Lupang Arenda, partikular na sa pagbibigay ng basic services sa pamamagitan ng pagkakaroon ng tanggapan na malapit sa lugar ng bawat mamayan.  Ang gusaling mayroong limang (5) silid ay isa lamang patunay na ang bawat buwis na ibinibigay ng bawat mamayan ng barangay na ito ay naibabalik sa pamamagitan ng tapat na serbisyo na na-aayon sa pangangailangan ng ating ka-barangay.

Kasalukuyan, ang mga silid sa ibabang bahagi ng gusali ay kumakanlong sa dalawang mahahalagang opisina na gumaganap sa kanilang tungkulin para sa kapakanan ng taga-Lupang Arenda: ang Clerk Office at ang Barangay Informal Settlers Affairs Office o BISAO na siya ring Department of the Month para sa Buwan ng Marso 2013.  

Ang renovation ng Lupang Arenda Extension Hall ay simula lang ng mas marami pang proyektong pang-inprastraktura ng Pamahalaan Barangay.  Kamakailan lang ay binendisyunan ang bagong ayos na gusali sa Exodus Floodway, isang linggo lang ang lumipas ay sabay na pina-sinayaan din ang Purok Extension Hall ng Ilang-ilang at ang pagsasa-ayos ng isang gusali sa Barangay Hall Central.    Kasalukuyan ding tina-tapos ang pagsasa-ayos ng Purok Hall sa Purok 8 Bagong Pag-Asa sa Floodway.

Avelino delas Alas-Ex-village chief in vote-rich site shot dead, P0.3-M reward raised for gunman's capture


TAYTAY, Rizal – A lone gunman shot in the head a former barangay chairman of a lakeshore community known for yielding solid votes, and probers are eyeing the political angle, as the victim had recently joined the camp of the incumbent mayor.

Initial reports from the local police identified the casualty as 40-year old Avelino delas Alas, former chairman of Barangay Sta. Ana in this municipality east of Metro Manila.
Probers said he was supervising physical preparations for the feast of Sitio Lupang Arenda, when an unidentified man, armed with a .45 caliber hand gun, approached from behind and shot him once, hitting his nape. The suspect casually walked away and remains at large.

Village folk rushed the victim to the hospital but he was dead on arrival.

The victim had run for various local positions in the past, and recently reactivated his political work. Delas Alas, who lives in vote-rich Lupang Arenda, opted to join incumbent Mayor Joric Gacula’s group --- an angle that the police investigators are looking at.

Gacula denounced what he described as a senseless political killing and put up a P300,000 reward for the capture of the suspect.

Asked on who could have been behind the slaying, Gacula declined to comment but vowed to get to the bottom of it. “Politics should not be made a reason to have one person killed,” he added.

Delas Alas, also the president of the Lupang Arenda Homeowners Association, is known for delivering solid votes from the 80-hectare lakeshore relocation area inhabited by around 50,000 families who used to form part of squatter colonies from Metro Manila cities.

Taytay relocation site flooded for more than a year

A street in Barangay Sta. Ana, a relocation site in Taytay, Rizal, has been flooded for one year, earning the ire of its residents.
 

Since her family moved to Brgy. Sta. Ana, Taytay, Rizal, in November 2010, college student Rose Dianne Eola has had to wade through a flooded street just so she can get out of their block.

"Ilang buwan na po ang baha dito sa amin. Kahit po walang ulan ay hindi ito humuhupa. Kapag umuulan naman po ay lalong tumataas ang tubig at lumalagpas na sa gutter," she said in an e-mail to InterAksyon.
("Our street has been flooded for months. Even when it doesn't, the water still doesn't subside. When it does rain, the water rises even above the gutter.")
"Kung mataas po ang tubig, kinakailangan ko pa pong lumusong sa baha dahil lagpas na sa gutter ang tubig. May mga tricycle drivers po kasi na hindi nagaakyat sa tuyo at hinahayaang lumusong ang mga pasahero nila. Dahilan po nila ay hindi raw po maiakyat dahil po mataas ang gutter. Kaya po kahit nakasapatos ka, palulusungin ka pa rin po nila. Minsan po ay galit pa sila," she continued.

Some tricycle drivers refuse to bring their passengers to the dry pavement, and allow their passengers to wade through the flood. They say it's because they have difficulty maneuvering the tricycle because the gutter is high. Even when you're wearing shoes, they will still force you to wade through the flood. Sometimes they even get angry.")

Kids splash about in the water, no matter how dirty it might be.
Eola said moss had started to grow on the cemented pavements, making it slippery to walk on. Some residents have even gotten into accidents because of it. The students in the area, in particular, have a hard time getting to the nearby school.
Some drainages, according to Eola, are hazardously uncovered, the flood making them difficult to spot.
She also noted the dangers to the residents' health, with mosquitoes laying eggs and vermin leaving droppings in the water.
"Perwisyo po talaga ang baha dito sa amin," she said. ("This flood is really a hassle for us.")
Eola lives in Lupang Arenda, a 270-hectare settlement along the shore of the Laguna de Bay.

To purchase a sachet of shampoo or a bottle of softdrinks, residents have to brave through this water in Lupang Arenda.
According to a February press release by the Presidential Communications Operations Office, the strip of public land was appropriated by former President Fidel Ramos for the growing number of informal settlers in Metro Manila. 
When Ondoy hit, former President Gloria Macapagal-Arroyo ordered the relocation of residents from the same location.
The Aquino administration has since put a road dike in place to keep inhabitants safe.
In a phone interview with InterAksyon.com, head of the Municipal Engineering Department Engr. Ronald San Juan said the area was below water level, thereby resulting in floods.
"Talagang nasa shoreline ito ng Laguna Lake. Malalim talaga ito. Natatambakan pa ng basura at dumami na ang mga bahay," added San Juan.
("It is really situated on the shoreline of Laguna Lake. It is really deep. It has become a dumping ground for trash. The number of houses has increased, too.")

Home Along Da... not riles, nor river. But it seems like the latter.
He said the engineering department has been trying to improve public infrastructure for some time now. Roads, in particular, have already been put into place where there were originally none.
"Paunti-unti, sa abot ng makakaya." ("Bit by bit, as much as we can.")
Unfortunately, the municipality does not have enough to fund as many projects as he would like.
"Minsan nakakakuha sa national government ng kaunting grant para mai-develop. Pero ngayon walang pagkukunan dahil exhausted na ang funds, lalo na't third quarter na," he said.
("Sometime we are able to get money from the national government from grants. But we no longer have funds today, especially since we're already in the third quarter of the year.")
San Juan promised to send someone to inspect the area Friday to see what can be done.
As of press time, InterAksyon.com has not been able to contact him as they were told he was out in the field.

2 public schools in Taytay sitting on top of danger zone

MANILA, Philippines - Aside from the shortage of teachers and classrooms and seasonal floods, two public schools in Taytay, Rizal were found to be sitting on top of a potentially danger zone.
The two elementary schools in Lupang Arenda, Tipayan Elementary School and the Arenda Elementary School, are situated inside 270 hectares of land on the shores of Laguna Lake.

Tipayan Elementary School is always flooded while the more than 2,000 students of the adjacent Arenda Elementary School are cramped in just 14 classrooms so that the school has to schedule three shifts so they can be taught by teachers who are lacking in number.
But the greater danger lies in the fact that the area, where the schools are located, is already saturated in water which may cause liquifaction of the soil, and may pose real danger during an earthquake.

MALACAÑANG said the government has set up a road dike in some areas of Lupang Arenda in Taytay, Rizal to minimize or prevent further liquefaction and to keep the residents safe from any disaster.

Presidential spokesperson Edwin Lacierda issued the statement Monday amid reports that the entire 270-hectare Lupang Arenda in Taytay, Rizal, is unsafe for human settlement because of liquefaction.

Lupang Arenda was established when former President Fidel V. Ramos issued Proclamation 704 and opened some 200 hectares of public lands in protected wetlands to accommodate the growing number of illegal settlers in Metro Manila. The settlement lies along the shorelines of Laguna de Bay and the natural lake water egress to Manila Bay along the Napindan Channel.

"After Ondoy, former President Gloria Macapagal-Arroyo issued an Executive Order (EO) ordering the relocation of the families in Lupang Arenda. By that time there were already 50 thousand families occupying Lupang Arenda," Lacierda said.

Residents in Lupang Arenda were displaced when Typhoon Ondoy struck Metro Manila and nearby provinces in September 2009.

"The DENR (Department of Environment and Natural Resources) has assessed and continues to assess Lupang Arenda, as some parts of Lupang Arenda were not suffering from liquefaction. What we have done thus far is to set up a road dike to minimize or prevent further liquefaction," he said.

Lacierda said there are ongoing studies on Lupang Arenda to determine whether the site is safe or not for human settlement.

"The administration is fully aware of the situation in Lupang Arenda and once we have the final decision made, we will inform the public. And yes, we are very much concerned about avoiding another disaster in any area," he said. (SDR/Sunnex)

My Flyers Which I Got for Free
“Tobit, sikat ka na, may mga flyers na kumakalat sa munisipyo na naka-print screen ang facebook profile mo.”
Those words were my friends’ morning greeting to me when I entered our office. I actually don’t know what to feel since the scenario was still so vague as it also made  me  think if I had done anything wrong, since my conscience clearly says that there is none. They then explained to me that it was about my facebook post saying “Joric, humanda ka. Nakikita mo ba tong mga papel na to? Para sa’yo to. It’s Payback time” while flashing an angry face and a bunch of papers on my hand. I then started to become conscious of how I looked on that picture more than the thought of ‘what’s the big deal out of that post?’ It is simply because, I know that what I posted was the truth. The ‘bunch of papers’ on my hand is the compilation of all the administrative complaints filed by the people against our municipal mayor and that indeed is really, ‘payback time’.
I apologize if the language I used in that post is in anyway foul or obscene. I was angry then, very much angry. And who would not be?
The Complaints that gained Complaints
Earlier that day, I was tasked to compile all the complaint materials to be filed by our barangay against the municipal mayor. It was a task I’d been wanting to do for so long since what we had experienced from the municipal mayor is something that we should not be quiet about. As I gather them and as I stare at these facts, I began to feel this anger.
Here are the lists of the complaints and I want you to judge as objective as you can, if the actions done by the municipal mayor was morally right or wrong,  politically correct or wrong or simply, just or unjust.
a.) The Taking Over of the Liga ng mga Barangay Office at the Municipal Hall
Having been elected as the Liga president, Barangay Chairperson Joselito Calderon, a known oppositionist, becomes an automatic ex-officio member of the Sangguniang Bayan. Immediately after the election for the said post dated December 7, 2010, Mayor Gacula, through the building administrator Eleno Tolentino, declared that the ABC office would now be used by the Municipal Health Clinic. This became an issue in the Sangguniang Bayan as Vice Mayor Janet Mercado stated in one of her privilege speeches, the unfairness of this act as she also questioned the grounds for this decision. The Sangguniang Barangay also wrote a letter to Mayor Gacula and to Mr. Tolentino to ask for the ABC office’s ownership. The office of the mayor through Mr. Tolentino reiterated their decision of not having the ABC office in the municipal hall.
The Sangguniang Barangay went to the MLGOO-DILG officer, Ms. Myrnalyn Tomas to seek assistance regarding this case. She told us that Mayor Gacula called to inform her that he  will be transferring the DILG office  to the supposedly office of the ABC. She said that she declined the offer, only to find out the following day that they are already transferring their things to the said office.
b.) The Forced Take Over of the Barangay Health Center
A few days after the first incidence, December 23, 2010, Municipal Health Officer Dr. Gerardo Camba together with at least 20 police swat headed by Taytay PNP Chief Col. Arthuro Masungsong went to the barangay to get the supplies, equipments, furniture and medicines without prior notice or even a letter to the barangay that they will be doing such act. The team, headed by Dr. Camba said that it was an order coming from Mayor Gacula and that they have the right to collect those properties since the health center itself belongs to the “municipality”. Concerned citizens of the barangay barricaded the truck that contains the collected properties as a sign of their protest for this action, but due to the police swat that was present, Dr. Camba’s team proceeded with the command to get all these properties (See amateur video documentation of the incident at: http://www.youtube.com/watch?v=tSi-gSSFSEc&feature=player_embedded).
To date it has been found out that these properties were transferred after a month, at the vicinity of Benjamin B. Esguerra Memorial National High School. The municipal government said that it is now the location for the new barangay health center, which gained criticisms from the people since the new location is not easily accessible and is not physically conducive for proper health care service. A lot of complaints also arise due to the fact that this new health center was not able to provide vaccination to some children.
To date, the Sangguniang Barangay has been able to provide quality health care services through the outpouring help of volunteer nurses and doctors.
c.) Forceful Take Over of Purok Halls and Barangay Annexes and Issues of Political Harassment
Early January of this year, Mayor Gacula issued certifications in the area of Lupang Arenda of this barangay, stating that certain properties such as the basketball court, day care center and barangay outpost and annexes are owned by the municipal government of Taytay since it was constructed under his administration. This certifications disabled the barangay employees to enter their work places since majority of these offices were padlocked.
Due to this claim, an incident happened on the 25th day of the same month wherein the Secretary of the barangay, Mr. Danilo Paz was forcefully arrested while he was inside the halls of Purok 1, Lupang Arenda. Sec Danny is already 65 years old and he was accused and initially charged with trespassing, resisting arrest and insubordination among others for being inside a hall that the municipal mayor claims to be his.
d.) The Establishment of a Questionable Executive Order: An Abuse of Authority
The Sangguniang Baragay received a letter dated May 25 of this year to inform the barangay of an executive order he had ordered to create the TASK FORCE ALARM (Alliance of Lupang Arenda Reinforcement Movers) and CDPSO (Community Development and Public Safety Office). The EO has been created, according to Mayor Gacula, “to act as the enforcement arm of the municipality’s peace keeping power” in the area, thus duplicating the task of the barangay’s security enforcement in Lupang Arenda as it also becomes disadvantageous to the municipal government since the appointment of their assigned people would require budget for honorariums and other physical structures needed. More importantly, this act has created social boundaries and confusion among the citizens in Lupang Arenda. According to the purok chairpersons assigned at Lupang Arenda, the task force ALARM also enabled Mayor Gacula to assign Purok Chairpersons, by-passing their roles as assigned by the barangay. ALARM appointed Chairperson Avelino De Las Alas also assigned these certain “Coordinators” per purok that duplicates the duties of the purok Chairpersons assigned by the barangay.
In the same letter dated May 25, Mayor Gacula demanded that the barangay should vacate the Arenda extension hall so that it may be used by the Task Force ALARM. He even claimed in the same letter that that barangay extension hall is the property of the “municipality”. The Sangguniang Barangay immediately responded to oppose the demand letter with evidences that the barangay has been paying for the electricity bill of the said extension hall for the past years. To date, the barangay has not yet received any response from the side of the Mayor.
For once may I remind you, our dear public officials, that  the municipality you are referring to is not just you— it includes US, the people you are supposed to be serving. The money used to build those government properties were hard earned money of the tax payers and you have no right to claim it and name it after yourselves.
These are just few of the many things Barangay Sta. Ana has been hurdling in its less than a year of service. This is what you get when you go against the flow, when you try so hard to stick with your principle and when you value the truth more than the frills you may have if you dared to live with lies.
A lot of people are telling me to stop doing this— to stop throwing statements against the administration, to stop tweeting against them, to stop telling these things to the people. I actually thought that they do not believe me but it surprised me when they told me that they are just afraid of the possible consequences of stating the truth and so they choose to remain silent about it.
I was not born yet when martial law was imposed in this country but we had been discussing it since grade school. My elementary teachers also told us that “History repeats itself”, I did not understand it then not until now that I see history happening again. This time, I hope that we won’t be needing a Ninoy to offer his life to break the chain, I am simply just hoping, for all good people to come together, to speak out, to be vigilant and to do something for the better good.
 Sawa na akong marinig sa mga tao na, “naiipit ako”, “natatakot akong mawalan ng trabaho”, “wala akong magawa”, “hayaan na lang natin sila” and so on and so forth. If you know what is right, then you shall do your best to do it. No what if’s, No buts.
“For evil to triumph is for the good people to do nothing.”

NEW EO PRESSED FOR ARENDA SETTLERS

TAYTAY, Rizal — The local government asked Malacanang to seriously consider the issuance of a new executive order that would finally legitimize the settlement of some 50,000 families, who have been living in Lupang Arenda for the last 13 years.

In a statement, Taytay Mayor Joric Gacula urged Pres. Noynoy Aquino to issue his version of Proclamation 704-1995, which declares the 80-hectare Lupang Arenda in Barangay Sta. Ana as resettlement area amid findings of the Department of Environment and Natural Resources (DENR), which states that Lupang Arenda is suitable for habitation.

Gacula explained that the fact that the 50,000 families have been living at the Lupang Arenda for the last 13 years, renders them as ‘legitimate’ settlers under the Urban Development Housing Act (UDHA).

The local chief executive added that the executive order that was issued by former Pres. Arroyo, (which has earlier been repealed amid DENR study, findings and recommendations) resulted in serious repercussions in the socialized housing area, one of which is subjecting residents to fear of a possible eviction anytime.

“These families have been there even before many of us were made aware of the existence of Lupang Arenda. They are legitimate settlers and not squatters as what EO 854 refers them. Aside from the fact that the government does not have a viable place that would fit them all in one place, eviction and transfer of these families would displace them from work and livelihood”, Gacula said in his statement.

He however admitted that the area is flood prone, but only because the road dike has yet been fully completed. The road dike is a government flagship project designed to seal of the entire Laguna de Bay and keep its water from spilling into the surrounding towns.

Gacula added that the local government in cooperation with the national government has been implementing infrastructural works that would alleviate the perennial problem of floods not just in Lupang Arenda but in all the localities surrounding Asia’s second largest freshwater basin.

THE construction of single detached residences will be banned in Metro Manila to optimize land use, Vice President Jejomar Binay told the Senate on Thursday.


“We will start to regulate residential land use. We will have to go vertical and start constructing multi-story houses to maximize the remaining spaces,” said Binay, head of the Housing and Urban Development Coordinating Council.


Antonio Bernardo, head of the Housing and Land Use Regulatory Board, said the consultations with local government executives would be finished within the year, and the final draft of the policy would soon be out and might include private subdivisions.


“As far as government housing is concerned, we will only construct, finance and guarantee medium- rise buildings, and if the local government units will recommend, the regulation will also apply to private subdivisions.” Bernardo said.


Binay said Singapore and Malaysia had been regulating urban land use and were successful in optimizing the use of the available space in the populated areas.


“Valenzuela already has a pilot project in place,” Binay said.


“They have constructed a community on medium- rise buildings and optimized limited space for other facilities and recreation, day care and multi-purpose enclosures.”


Binay said the relocation of squatters would also be done “in-city” as most of those who had been relocated outside Metro Manila had merely returned to squat in congested areas.


“We have constructed 5-story mass-housing facilities with 20-square-meter units,” he said.


“We will give priority to relocate those from Lupang Arenda.”


Lupang Arenda is a relocation site in Tanay, Rizal, that has proved to be prone to flooding in the typhoon season as it has become a natural catch basin for the overflow spills from Laguna Lake.


Binay said the Housing Council was aiming to provide low-cost housing to 580,000 families in Metro Manila.


He said the Pag IBIG fund had made P5 billion in calamity loans available to members whose houses were damaged by typhoon Pedring. The releases would be equivalent to 80 percent of a member’s accumulated savings.

Due to its Sports Development Program, Taytay eyed the construction of Taytay Sports Complex which is the new seat of sports development in Rizal.

University Of Rizal System - Taytay Campus is already open for the youths of Taytay who don't have enough money for their college studies.

The road widening of Rizal Avenue and Manila East Road was already done. Taytay is also planning for the construction of a new hi-way called Kalayaan Ave. that will connect the Barangays of Dolores, San Juan and Muzon.

The highly ambitious project of the construction of Metro Manila International Airport to be completed in 2015 in cooperation with Taguig City will again add wealth to the increasing revenues of Taytay. 
Since the airport is adjacent to the vicinity of Taytay (Lupang Arenda in particular), hotels, high-rise condominiums will take place. The new TESDA in Taytay is now open. the said office is the largest in the country It is located back of the New Taytay Municipal Hall.

MANILA, Philippines - The municipal mayor of Taytay in Rizal is urging the Palace to seriously consider issuing a new executive order that would legitimize the settlement of some 50,000 families living in Lupang Arenda for the last 13 years.
 
In a statement, Taytay Mayor Joric Gacula urged President Benigno Aquino III to issue his version of Proclamation 704-1995, declaring the 80-hectare Lupang Arenda in Barangay Sta. Ana as a resettlement.
 
Gacula made the call after Department of Environment and Natural Resources (DENR) found that the vast parcel of land as suitable for habitation.
 
The mayor said that the fact that the 50,000 families have been living in Lupang Arenda for the last 13 years makes them ‘legitimate’ settlers under the Urban Development Housing Act (UDHA).
 
He added that the executive order that was issued by former President Gloria Macapagal- Arroyo resulted in serious repercussions in the socialized housing area, one of which is subjecting residents to fear of a possible eviction at any given time. 
 
The order has earlier been repealed despite the DENR study, findings and recommendations. 
 
"They are legitimate settlers and not squatters as what EO 854 refers them. Aside from the fact that the government does not have a viable place that would fit them all in one place, eviction and transfer of these families would displace them from work and livelihood”, Gacula said in his statement.
 
He however admitted that the area is flood prone, but only because the road dike has yet been fully completed.  
 
The road dike is a government flagship project designed to seal of the entire Laguna de Bay and keep its water from spilling into the surrounding towns. -- Dennis Carcamo

Alamin ang Eviction At Demolisyon



1. Ano ang ebiksyon?Ang ebiksyon ay ang pag-alis sa isang tao at sa kanyang mga pagmamay-ari mula sa isang gusali/istraktura o lugar o pareho, nang sangayon sa batas (Section 3(g) ng Implementing Guidelines ng Executive Order Blg. 152, Taong 2002)

2. Ano ang demolisyon?
Ang demolisyon ay ang pagtitibag ng lokal na pamahalaan, o ng sinumang awtorisadong ahensiya ng gobyerno ng mga istraktura sa lugar na sakop ng clearing. (Section 3(f) ng Implementing Guidelines ng Executive Order Blg. 152, Taong 2002)

3. Ano ang polisiya ng gobyerno hinggil sa ebiksyon at demolisyon?

Ayon sa ating Saligang Batas (Section 10, Article XIII), hindi patatalsikin ang mga naninirahan at hindi titibagin ang mga gusaling bahay ng mga maralitang tagalungsod at mga maralita sa kanayunan, maliban na lamang kung ito ay alinsunod sa batas at sa isang makatarungan at makataong pamamaraan.

4. Anong batas ang sumasaklaw sa ebiksyon at demolisyon?
Ang Batas sa Pagpapaunlad ng Kalunsuran at Pabahay (Urban Development & Housing Act/UDHA) o Batas Republika bilang 7279, higit sa lahat ang Section 28, ang nagtatakda ng mga tuntunin sa ebiksyon at demolisyon. Dagdag rito, mayroong iba’t ibang Executive Orders (hal. EO 152, taong 2002) at kanilang mga kalakip na mga Implementing Guidelines, Rules o Regulations at mga Circular (hal. OCA Circular bilang 72-2003) na inilathala ng pamahalaan upang lubos na maabot ang mga mithiin ng UDHA.

5. May bisa ba ang EO 152 at ang IRR nito alinsunod sa UDHA, LGC at prinsipyo ng debolusyon?
Oo. Nagmumula ang bisa ng nasabing pahayag sa kapangyarihan ng Pangulo na pangasiwaan ang lokal na gobyerno upang masiguro na ang mga batas ay nasusunod, ayon na rin sa doktrina ng “qualified political agency”.
Sa ilalim ng EO 152, ang Lupon ng Pangulo para sa Maralitang Tagalungsod (Presidential Commission for the Urban Poor/PCUP) ang magsisilbing “sole clearing house” o natatanging ahensiya ng gobyernong na magpapatakbo ng demolisyon at ebiksyon. Sapagkat ang lokal na gobyerno ang pangunahing tagapagpaganap ng UDHA, nang itinalaga ng EO 152 ang PCUP bilang “sole clearing house”, lalong pinagtibay ang papel ng PCUP bilang nangangasiwa sa mga ebiksyon at demolisyon.

6. Ano ang tuntunin ng UDHA ukol sa ebiksyon at demolisyon?
Ayon sa Section 28 ng UDHA, ang pagpapatalsik ng mga naninirahan at pagtitibag sa mga gusaling bahay, hanggat sa maaari, ay iiwasan.

7. Mayroon bang mga exception dito?
Mayroon. May mga pagkakatataon na pinahihintulutan ang ebiksyon at demolisyon ng batas:
a. Kapag naninirahan sa mga mapanganib na lugar tulad ng mga estero, sa tabi ngpic3 riles, mga tambakan ng basura, tabing-ilog, baybayin (Section 28, UDHA)
b. Kapag ito ay gagwin sa mga pampublikong lugar tulad ng bangketa, kalsada, liwasan at palaruan (Section 28, UDHA)
c. Kapag may itatayong proyektong pampubliko na may sapat na pondo at agad na sisimulan (Section 28, UDHA)
d. Kapag may hatol na ang korte (Section 28, UDHA)
e. Mga bago at ilegal na istrakturang itinayo pagkatapos ng ika-28 ng Marso, 1992 (Section 30, UDHA)
f. Mga istrakturang pagmamay-ari ng mga propesyunal na iskwater o mga kasapi ng sindkato ng mga propesyunal na iskwater (Section 27, UDHA)

8. Ano ang mga uri ng ebiksyon at demolisyon?
Sa ilalim ng Implementing Guidelines ng EO 152, taong 2002, ang mga sumusunod ang mga uri ng ebiksyon at demolisyon:
a. Mayroong kautusan ng korte (judicial/court-ordered)
- sa pamamagitan ng kautusan na ipinalalabas ng isang korteng may sakop sa lugar
b. Walang kautusan ng korte (extra-judicial)
- hindi kinakailangan ang utos ng korte at patungkol sa mga kapus-palad at walang tirahang mamamayan at sa kanilang mga tinutuluyan sa : 
1. mga mapanganib na lugar
2. mga pampublikong lugar
3. sa lugar na may itatayong proyektong pampubliko na may sapat na pondo at agad na sisimulan (Section 3(a))
c. Summary - ang kagyat na pagtanggal at pagtitibag ng lokal na gobyerno o awtorizadong ahensiya ng mga istraktura ng:
1. propesyunal na iskwater
2. kasapi ng sindkato ng mga propesyunal na iskwater
3. bago at ilegal na itinayo pagkatapos ng ika-28 ng Marso, 1992 (Section 3(p))
d. Pagkukusang loob (voluntary) - Nagkukusang loob na lumulikas o pumapayag na tibagin ang istraktura

9. Ano ang mga kailangan upang maging legal ang ebiksyon o demolisyon?


Nakasaad sa Section 28 ng UDHA ang mga patakaran na kailangan sa ebiksyon o demolisyon. Kinakailangang sundin ang lahat ng mga patakaran upang magkaroon ng bisa ang ebiksyon o demolisyon:
1. Abiso sa mga apektadong residente 30 araw bago ang takdang petsa ng ebiksyon/demolisyon;
2. Sapat na consultasyon o pagsasangguni ukol sa paglipat ng mga apektadong residente kasama ang mga kinatawan ng pamilyang malilipat at ng mga komunidad na kanilang lilipatan;
3. Sapat na lugar na mapaglilipatan, pansamantala man o permanente
4. Dapat na naroroon sa takdang oras ng ebiksyon/demolisyon ang mga lokal na pinuno o ang kanilang mga kinatawan
5. Sapat na pampakilala sa lahat ng mga lalahok sa ebiksyon/demolisyon;
6. Pagsasagawa ng ebiksyon/demolisyon sa loob ng oras pang-opisina, mula Lunes hanggang Biyernes, at kapag maganda ang panahon, maliban na lamang kung papayag ang mga residente;
7. Hindi gagamit ng heavy equipment para sa demolisyon maliban na lamang kung
ang titibagin ay permanente at yari sa konkreto;
8. Naka-uniporme ang mga pulis na kasangkot;

10. Mayroon bang pagkakataong hindi na kinakailangan ang mga nakasaad?
Oo. Sa mga pagkakataong ang titibagin ay mga istraktura ng propesyunal na iskwater, maaring magkaroon ng summary o kagyat na demolisyon.

11. Sino ang kinikilala bilang “mga kapus-palad at walang tirahang mamamayan?”
Ang mga kapus-palad at walang tirahang mamamayan ay yaong mga itinalagang makinabang sa UDHA at sa mga indibidwal o pamilya na naninirahan sa mga lungsod o malalungsod na lugar: 
1. na may kita na pumapaloob sa poverty threshold na tinakda ng National Economic and Development Authority, at
2. hindi nagmamay-ari ng kanilang sariling tirahan at walang security of tenure.

12. Sino ang mga “professional squatter”?
Ang mga propesyunal na iskwater ay ang mga tao o grupo ng tao na:
1. Nananalagi sa lupain na walang pahintulot sa may-ari at mayroong sapat na pangkabuhayan para makakuha ng legal na pamamahay.
2. Maaari ring nabigyan na ng pabahay ng gobyerno ngunit ibinenta, pinaupahan, o ipinamahagi sa iba para sila ay makalipat sa ibang lugar.
3. Maaaring mga taong walang karapatang mamalagi sa mga lugar na nakalaan para sa proyektong pabahay ng pamahalaan

13. Ano ang “squatter syndicate"?

Ang mga sindikato ng mga iskwater mga grupo ng tao na ginagawang negosyo ang pabahay sa iskwater upang makakuha ng kita o tubo.

14. Sakop ba ng UDHA ang mga demolisyong ipinataw ng husgado?
Oo. Tuwirang tinutukoy ang Section 28 ng UDHA ang mga demolisyon na ipinataw ng husgado bilang isa sa mga pagkakataong liban sa polisiya na “walang demolisyon at ebiksyon”.

Higit pa dito, dahil sa ang lahat ng ebiksyon ng mga kapus-palad at walang tirahang mamamayan at ang demolisyon ng kanilang mga tirahan ayon sa ibang batas ay saklaw ng Section 28, ang pagpapatupad ng hatol ng husgado matapos ang mga kaso ng forcible entry, unlawful detainer, accion publiciana at accion reinvindicatoria ay dapat na sumangayon sa UDHA, lalo na kung mayroong maapektuhan ang mga maralitang tagalungsod.

15. Ano ang ninanais na daloy ng isang ebiklsyon o demolisyon na ipinataw ng husgado?
Ang ebiksyon o demolisyon na gagawin sa bisa ng utos ng husgado ay kinakailangang tupdin ang mga sumusunod:

Una, matapos na maibaba at maging pinal ang hatol ng korte, magpapadala ito ng mga abiso sa:
a. lokal na gobyerno (LGU) at/o ang National Housing Authority. Mayroong 45 na araw ang mga nasabing ahensiya upang maghanap ng sapat na malilipatan ang mga apektado ng ebiksyon o demolisyon, at kung walang mapaglilipatan, maghanda ng tulong pinansyal.
b. Presidential Commission for the Urban Poor (PCUP) 5 araw bago ang ebiksyon o demolisyon.

Pangalawa, matapos na matanggap ang mga abiso, at sa loob ng nasabing 45 na araw, kinakailangan ng LGU/NHA na:
a. magbigay ng abiso sa mga apektadong residente 30 araw bago ang takdang ebiksyon o demolisyon
b. magsagawa ng konsultasyon kasama ang mga residente, at
c. maghanda ng sapat na lugar na malilipatan o ng tulong pinansyal.

Pangatlo, kapag mayroon nang lugar na mapaglilipatan o mayroon nang pondo para sa tulong pinansyal matapos ang 45 na araw, maglalabas ang korte ng isang writ of execution o kautusan upang isagawa ang demolisyon. Nakasaad sa nasabing kautusan na dapat sundin ng sheriff o tagapagpatupad ang mga patakarang nasasaad sa Section 28 ng UDHA para sa makatarungan at makatao paraan ng ebiksyon at demolisyon.

16. Ano ang mga kapangyarihan at katungkulan ng PCUP?

Sa ilalim ng EO 152, ang PCUP ay nagtataglay nang mga sumusunod na kapangyarihan at katungkulan: 
a. bantayan ang lahat ng ebiskyon at demolisyon, mayroon man itong kautusan ng korte o wala;
b. bago pa man ang aktwal ng demolisyon at ebiksyon, utusan ang mga kasangkot na ahensiya ng pamahalaan, kabilang ang lokal ng gobyerno, na kumuha mula sa PCUP ng mga talaan ng gawain, guidelines o mga patakaran, at compliance certificates;
c. pagkatapos ng ebiksyon at demolisyon, ipapasa ng mga kasangkot na ahensiya sa PCUP ang mga talaan ng gawain, na sinumpaan ng nagpasa at sinasabing: 
1. nagkaroon ng sapat na konsultasyon kasama ang mga pamilyang apektado,
2. mayroong sapat at angkop na lugar na mapaglilipatan ang mga apektadong pamilya
3. natupad lahat ng mga patakaran sa ilalim ng IRR ng UDHA.
d. maglathala ng compliance certificates batay sa mga talaan ng gawain ipinasa ng mga ahensiya
e. magsiyasat, ayon sa sariling pagpapasiya o batay sa isang reklamong inihain ng sinuman, tungkol sa mga paglabag sa Section 28 ng UDHA
f. magsampa ng kasong kriminal, sibil o administratibo sa mga tao o taong matatagpuang lumabag sa Section 28 ng UDHA.
g. ipayo sa Pangulo ang anumang mga nararapat na hakbang sa pagpapatupad ng Section 28 ng UDHA at sa IRR nito;
h. humingi ng tulong at impormasyon sa ibang ahensiya ng gobyerno na makakatulong sa gawain ng PCUP;
i. ipaabot sa kaalaman ng karamihan ang tungkol sa mga pagsisiyasat ng mga paglabag sa Section 28;
j. magbigay ng panunumpa, maglabas ng mga subpoena at subpoena duces tecum, at mangalap ng mga testigo sa daloy ng pagsisiyasat
k. magpanukala at magpatupad ng sarili nitong mga panuntunin sa pagsisiyat. 

17. Ano ang certificate of compliance?

Ang certificate of compliance ay binibigay ng PCUP upang ipakita na natupad na ng ahensiyang kasangkot ang lahat ng mga patakaran tungkol sa ebiksyon at demolisyon.

18. Sakop ba ng EO 152 at ng IRR nito ang mga lokal na gobyerno at ibang ahensiya?
Oo. Nagmumula ang bisa ng EO 152 sa kapangyarihan ng Pangulo na pangasiwaan ang lokal na gobyerno upang masiguro na ang mga batas ay nasusunod. Samakatuwid, bagamat may mga LGU na mayroong sariling “clearing houses”, kinakailangan pa rin dumaan sa PCUP ang lahat ng ebiksyon at demolisyon upang masiguro na nasusunod ang lahat ng itinakda ng Section 28 ng UDHA, at pare-pareho ang pagpataw ng mga patakarang ito sa lahat ng magsasagawa ng ebiksyon at demolisyon. Ito ay pinapatupad sa pamamagitan ng pangangailangan sa compliance certificate.

19. Kinakailangan ba ng compliance certificates sa ilalim ng EO 152 kapag magpapatupad ng summary evictions o demolitions?

Oo. Kinakailangan ng compliance certificate kung magsasagawa ng summary eviction upang mapangalagaan ang mga karapatan ng mga naninirahan sa mga bago at ilegal na istrakturang itinayo pagkatapos ng ika-28 ng Marso, 1992 na maaring sakop ng UDHA kung sila ay kapus-palad at walang tirahang mamamayan. Dagdag pa dito, masasabing napapailalim pa rin sa tungkulin ng PCUP na bantayan ang lahat ng mga ebiksyon at demolisyon ang mga kaso ng summary evictions.

20. Kinakailangan ba ng compliance certificates sa ilalim ng EO 152 kapag magpapatupad ng ebiksyon at demolisyon na mayroong kautusan o hatol mula sa korte?

Hindi. Nasasaad sa EO 152 at sa IRR nito na hindi na kinakailangan ng compliance certificate sa mga pagkakataong mayroon ng hatol ang husgado. Ngunit tungkulin pa rin ng PCUP na bantayan ang aktwal na pagsasagawa ng ebiksyon at demolisyon.

21. Ano ang nakatakdang papel ng lokal na gobyerno sa mga ebiksyon at demolisyon?
Ang lokal na gobyerno at ang NHA, sa tulong ng ibang ahensiya ng pamahalaan ay nakatakdang:
a. maghanap at magpalipat sa mga apektadong residente sa mga angkop na lugar sa loob ng 45 na araw mula sa maibaba at maging pinal ang hatol ng korte;
b. magbigay ng tulong pinansyal, kung sakaling hindi maisasagawa ang paglipat, sa halagang katumbas sa 60 araw na umiiral na pinakamababang sahod (minimum daily wage multiplied by 60 days) 


22. Maari bang ipagpaliban ng LGU o NHA ang kanilang tungkulin na magbigay ng sapat na relokasyon sa pamamagitan ng pagbibigay ng tulong pinansyal sa mga apektadong pamilya?


Hindi. Ang pagbibigay ng sapat na relokasyon ay dapat gawin dahil ito ay nasasaad sa Konstitusyon. Ang pagpapaliban sa pagibigay ng relokasyon, sa mga sitwasyong may naibigay nang tulong na pinansyal sa mga pamilyang apektado dahil ang relokasyon ay hindi na posible dahil nakalipas na ang 45 na araw, ay pansamantala lamang. Ang pagtanggap ng tulong na pinansyal ay hindi nangangahulugan na tinatalikuran na ng mga apektadong pamilya ang kanilang karapatan na humingi at mabigyan ng pamamahay.

23. Maari bang gawing ng mga LGU’s ang agarang o summary demolisyon ng mga istraktura at pagpapaalis sa mga nagmamay-ari ng mga istraktura sa mga pribadong lupain sa ilalalim ng UDHA?


Hindi. Ang kapangyarihan ng mga LGU para magsagawa ng demolisyon na summary o agaran na pagtatanggal ng mga istraktura ay sa mga pampublikong lugar at mapapanganib na lugar na nasasaad sa batas. Ang kapangyarihan na ito ay hindi sumasakop sa mga pribadong pag-aari. Ang ebiksyon at demolisyon sa pribadong pag-aari ay dapat iasagwa sa pamamagitan ng kautusan mula sa korte.

24. Maari ba itong gawin ng mga LGU sa ilalim ng ibang batas?

Hindi. Bagamat sa ilalim ng Civlil Code sa mga probisyon sa Nuisance, sa Building Code (PD 1096), sa ilalim ng Local Government Code (Sections 444 at 455, RA 7160) at iba pang mga batas at direktiba tungkol sa demolisyon (LOI 19, PD 292, atbp) ay napapatungkol sa demolisyong ng ibang mga ilegal na istraktura,. Ang mga batas na ito ay napalitan o nabago na ng Seksyon 28 ng UDHA, isang batas na mas nakatuon sa mga demolisyon ng mga istarktura ng mga mga kapus-palad at walang tirahang mamamayan

25. Maari bang isagawa ng mga LGU o iba pang mga bahagi ng pamahalaan ang summary na demolisyon sa mga baguhan na naninirahan (pagkatapos ng 1992) sa mga pampublikong lupain o lugar na nanirahan sa mga lugar na iyon pagkatapos mapaalis sa pamamagitan ng kautusan ng korte mula sa pribadong lupain ngunit maaring magkaroon ng benepisyo sa ilalim ng UDHA bago sa kanilang ebiksyon?


Hindi. Ang kapangyarihan para magsagawa ng demolisyon ay hindi sumaklaw sa mga may benepisyo mula sa UDHA na napaalis mula sa mga pribadong lupain. Habang ang mga LGU o o iba pang mga bahagi ng pamahalaan ay maaaring magsagawa ng demolisyon sa mga baguhan na naninirahan sa mga pampublikong lugar pagkatapos ng pagpapairal ng UDHA sa ilalim ng seksyon 30, hindi nila maaring gamitin ang kapangyarihang ito kung ang mga tao na paalisin o gigibain ang bahay ay mga baguhan na naninirahan (pagkatapos ng 1992) sa mga pampublikong lugar na nanirahan doon pagkatapos mapaalis mula sa pribadong lupain sa pamamagitan ng kautusan ng korte pero sila ay mga maaring makatanggap ng benepisyo sa ilalim ng UDHA at naroon na sila sa lupa bago pa nung Marso 28, 1992.

26. Kailan pinapayagan na magbigay nang tulong ang pulisya kapag may ebiksyon o demoliyon?

Ang mga nasasangkop na departamento at ahensya ng gobyerno, ang mga LGUs o iba pang nagsasagawa ng ebiksyon at demolisyon ay bibigyan lamang ng tulong ng pulisya kapag nagampanan nila ang mga nakasaad na patakaran sa ilalim ng UDHA at ang mga implementing rules nito, pati na ang checklist and compliance certificate requirements sa ilalim ng E.O. 152.

Ang tulong ng pulisya ay pahihintulutan lamang sa mga sumusunod na sitwasyon:
a. Sa pagsunod sa kautusan ng korte na nagsasaad ng pagbibigay ng tulong o pag aksyon ng pulisya
b. Sa anumang sitwasyon o pangyayari na mayroong kusang ebiksyon o pagbaklas ng mga istraktur na napagkasunduan sa iasang kasulatan sa pagitan ng mga partido na nasasangkop at ito ay inaprubahan ng PCUP
c. Sa mga sitwasyon ng local na proyektong pang imprastraktura na inaprubahan ng PCUP
d. Sa mga sitwasyon ng pambansang proyektong pang imprastraktura na inaprubahan ng PCUP
e. Sa iba pang sitwasyon ng ebiksyon at demolisyon na kung saan ang tulong ng pulisya ay kinakailangan upang mapanatili ang kapayapaan ay kayusan, basta ito ay inaprubahan ng PCUP


27. Kailingan bang isaad sa kautusan na ibibigay ng korte na magbibigay ng tulong ang pulisya?

Hindi. Ang kahilingan na nakasulat ng sheriff para sa tulong ng pulisya sa pagsasatupad ng kautusan ng korte ay sapat na. Ang mga pulis na nabigyan ng pahintulot ay magbibigay ng pasabi sa PCUP sa isang kasulatan na nagsasaad na nabigyan na sila ng pahintulot na magbigay ng tulong at ang petsa ng ebiksyon at demolisyon sa hindi kukulanin ng 3 araw bago ang pagsasagawa nito.

28. Ano ang hangganan ng tulong na ibibigay ng pulisya sa isang ebiksyon at demolisyon?

Ang tulong na ibibigay ng pulisya ay limitado sa pagpapairal ng batas at pagpapanatili ng kapayapaan at, sa kahit anumang sitwasyon, hindi sa pagsama at pagsagawa ng ebiksyon at demolisyon. Ang mga miyembro ng PNP na naatasang magbigay ng tulong ay dapat nakasuot ng tamang uniporme at, sa mga nararapat na sitwasyon, magdadala ng mga kinakailangan na dokumento na nagsusuprta sa kanilang pagaksyon at pagtulong.

29. Ano ang maaaring gawin ng mga pamilya ng maralitang taga-lungsod na sumailalim sa demolisyon sa mga kasong ang taong humingi nito ay hindi nakasunod sa mga nakasaad sa batas na dapat gawin bago magkaroon ng demolisyon?


Mayroong ilang remedyo na maaring gawin:
• Kapag ang demolisyon ay isasagawa pa lamang, ang mga pamilyang apektado ay maaring humingi ng Injunction o Prohibition mula sa mga korte
• Kapag ang demolisyon ay nasagwa na, pwde silang magsampa ng kaso para sa damages, na kung saan pwede silang humingi ng actual, moral at exemplary damages
• Pwede rin silang magsampa ng kasong criminal sa mga taong nagsagawa ng demolisyon na hindi naaayon sa batas sa ilalim ng Sksyon 45 ng UDHA

30. Ano ang mga maaaring maging pananagutan ng mga tao o taong lalabag sa mga batas tungkol sa ebiksyon at demolisyon? 

Sa ilalim ng section 45 ng UDHA ay nakasaad na ang sinumang tao na lalabag sa mga anumang probisyon ng UDHA ay papatawan ng parusang pagkakakulong ng hindi hihigit sa anim (6) na taon o multa na hindi bababa sa limang libong piso (5000) ngunit hindi hihigit sa sampung libong piso (10000) o kaya ay pareho itong ipapataw.

Kasama rito, sa ilalim ng section 7 ng EO 152, ang sinumang opisyal ng PCUP na magbibigay ng endorsement ng deomlisyon o ebiksyon nang walang kumpletong checklist, o kung ang checklist ay ibinigay ngunit ito ay hindi na-certipikahan, o kaya ay sinumang opisyal o miyembro ng PNP na makikibahagi o magbibigay ng tulong sa ebiksyon o demolisyon ng walang pahintulot ng PCUP, sila ay mapapatawan ng nararapat na parusa, na hindi pumipigil sa iba pang kasong criminal o civil na maaring isampa laban sa kanila.
